Terms of Use

1. Agreement to Terms

These Terms of Use (“Terms”) form a legally binding agreement between Marine Certify Check, Inc. (“Marine Certify Check,” “we,” “us,” or “our”) and you (“you” or “your”), governing your access to and use of:

  • The Marine Certify Check website
  • Any Marine Certify Check mobile applications
  • Any services, content, or features provided by Marine Certify Check (collectively, the “Services” or “Site”)

IMPORTANT: By visiting the Site or using any Marine Certify Check Services (with or without creating an account), you confirm that you have read, understood, and agreed to these Terms.
If you do not accept these Terms, do not access or use the Site or Services.

We may revise these Terms at any time. Updated versions will be posted to the Site, and your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

2. General Use

a. Description of Services

Marine Certify Check provides access to various features and content, including but not limited to:

  • Used boat listings
  • Boat history reports (and summaries)
  • “Sell My Boat” service
  • Ratings, reviews, and user-submitted content (“Submissions”)
  • Alerts, recall notices, service reminders, and offers related to boats
  • Content from third parties, including promotions and advertisements

Marine Certify Check may update, change, or discontinue any part of the Services at any time, without notice.

b. Account Creation & Responsibility

Some Services require account creation. By creating an account, you:

  • Agree to provide accurate and complete information
  • Must use a valid email address owned by you
  • May not impersonate another person or entity
  • May not include “Marine Certify Check” or similar terms in your username
  • Are solely responsible for maintaining the confidentiality of your password

You agree to receive communications electronically, unless otherwise noted in Section 19. All electronic communications between you and Marine Certify Check satisfy any legal requirement that they be in writing.

By creating an account, you further represent and warrant that:

  • You are 18 years or older and legally able to enter into this agreement
  • You own the boat(s) you register in the Marine Certify Check Service
  • All submitted information is true and accurate

3. Marine Certify Check Service

a. Service Overview

The Marine Certify Check Service is a personal boat management tool, designed to help users:

  • Track service and recall history
  • Receive maintenance reminders and alerts
  • View warranty information
  • Access service records
  • Receive personalized offers or third-party promotions (“Third Party Offers”)

This Service is informational only and is not intended to provide legal, financial, or tax advice.

b. License and Restrictions

Marine Certify Check grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services within the United States, for personal use only, and in accordance with these Terms.

You may not:

  • Reproduce, redistribute, or modify any portion of the Service
  • Use the Service for commercial purposes without permission
  • Violate applicable laws using the Service

c. Recall Information Disclaimer

Marine Certify Check sources recall data from most boat manufacturers in the U.S. However:

  • Recall data may not always be complete or up to date
  • Not all manufacturers provide real-time updates

We recommend confirming critical recall or safety information directly with your boat’s manufacturer.

4. User Submissions

By submitting content through the Site (including reviews, comments, ratings, photos, or other materials), you grant Marine Certify Check a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, publicly display, modify, and create derivative works of such content in any format and through any medium.

You represent and warrant that:

  • You own or have the necessary rights to grant this license
  • Your submissions do not infringe on any third-party rights or violate any laws
  • Your content is not defamatory, obscene, or otherwise unlawful

Marine Certify Check is under no obligation to monitor or remove submissions but reserves the right to do so at its sole discretion.

5. Prohibited Conduct

You agree not to use the Site or Services to:

  • Violate any applicable law or regulation
  • Infringe upon or misappropriate intellectual property rights
  • Transmit viruses or other harmful code
  • Use bots, crawlers, or scraping tools without express permission
  • Interfere with or disrupt the operation or security of the Services
  • Misrepresent your identity or affiliation with any person or entity

Marine Certify Check reserves the right to suspend or terminate your access to the Services for violations of these Terms.

6. Third-Party Content and Services

Marine Certify Check may provide links or access to content and services offered by third parties, including:

  • Boat dealers or service providers
  • Advertising partners
  • Analytics platforms (e.g., Google Firebase)
  • Marketing partners (e.g., Criteo SA, RTB House)

We do not control these third-party sites or services and are not responsible for their content, policies, or practices. You access and use third-party content at your own risk, and you should review their terms and privacy policies.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARINE CERTIFY CHECK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF INFORMATION
  • AVAILABILITY OR PERFORMANCE OF THE SERVICES

We do not guarantee that the Services will be error-free, secure, or uninterrupted.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARINE CERTIFY CHECK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES
  • LOST PROFITS, LOST REVENUE, OR LOST DATA
  • DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO MARINE CERTIFY CHECK IN THE SIX MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Marine Certify Check, its officers, directors, employees, and agents from and against all claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any rights of a third party, including intellectual property rights

10. Termination

Marine Certify Check may suspend or terminate your access to the Services at any time, with or without cause or notice, including if you violate these Terms.

Upon termination:

  • Your rights to use the Services will cease immediately
  • Certain provisions (e.g., indemnification, limitation of liability) will survive

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [Insert State], without regard to conflict of law principles.

Any disputes arising under or in connection with these Terms shall be resolved through:

  • Informal negotiation as a first step
